We recognise the responsibility to promote safe practice and to protect children from harm, abuse and exploitation while participating in our activities.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Staff and volunteers will work together to embrace difference and diversity and respect the rights of children and young people.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">For the purposes of this policy and associated procedures a child is recognised as someone under the age of 18 years.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">This policy is based on the following principles:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">The welfare of children is the primary concern<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">All children, whatever their age, culture disability, gender, language, racial origin, socioeconomic status, religious beliefs and\/or sexual identity have the right to protection from all forms of harm and abuse.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Child protection is everybody\u2019s responsibility.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Children have the right to express views on all matter which affect them, and are encouraged to do so.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Our organisation will work in partnership together with children and parents\/caregivers to promote the welfare, health and development of children.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Policy Objectives<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">The aim of this policy is to promote good practice through:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Promoting the health and welfare of children by providing opportunities for them to participate in badminton activities safely.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Respecting and promoting the rights, wishes and feelings of children.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Promoting and implementing appropriate procedures to safeguard the well-being of children and protect them from abuse.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Recruiting, training, supporting and supervising staff and volunteers to adopt best practice to safeguard and protect children from abuse and to reduce the risk to themselves.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Requiring staff and volunteers to adopt and abide by the Child Protection Policy and procedures.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Responding to any allegations of misconduct or abuse of children in line with this Child Protection Policy and procedures as well as implementing, where appropriate, the relevant disciplinary and appeals procedures.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Regularly monitoring and evaluating the implementation of this Child Protection Policy and procedures.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>Procedures<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>I.\u00a0 \u00a0Recruitment and Screening<\/b><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">As part of our duty of care, we must ensure that suitable and appropriate employees and volunteers (including parents) are engaged to work with children. When recruiting people to engage with children we will ensure that there is a robust recruitment process that includes:<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Creating a role description<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Developing candidate specifications<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Advertising the position<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">An application process<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Following up on references<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Interviewing<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Screening (Police Vetting) where appropriate<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Using all of the above to assess any risk to children from the individual<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>II.\u00a0 \u00a0Child Protection Officer<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">A Child Protection Officer* (CPO) will be appointed to manage child protection issues by:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Ensuring that child protection procedures are understood and adhered to by all members<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Organising promotional activities, training and raising awareness within the organisation<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Establishing and maintaining the complaints procedure<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Regularly reporting to the Board\/ Executive Committee\/ Management<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Acting as the main contact for child protection matters<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Keeping up to date with developments in child protection legislation<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Liaising with local child protection agencies<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Maintaining confidential records of reported cases and any action taken<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Regularly monitoring and reviewing existing policies and procedures<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">(* The CPO for BHV is Trish Cochrane 01\/05\/2020)<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\"><b>III.\u00a0 \u00a0Education and Training<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Education and training of staff and volunteers will help BHV to:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Recognise when children are at risk.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Take appropriate precautions to manage and limit identified risks.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Respond in an appropriate manner to children who have been harmed or are suspected of being harmed.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Understand our responsibilities in relation to keeping children safe both in terms of prevention and management responsibilities of cases that may arise.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">Staff and volunteers will be trained during their induction to a level appropriate to their role. BHV will also ensure that staff and volunteers receive ongoing education and training to keep up to date with any changes to the law or internal processes for managing incidents of harm to children<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>IV.\u00a0 \u00a0Good Practice Protocols<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">These protocols provide guidance to those working with children by outlining good practice and establishing boundaries in a range of situations.<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Applying a child-centred approach where all children are treated equally and with dignity.<\/span>\n<ul class=\"ul2\">\n<li class=\"li3\"><span class=\"s1\">Activities should be appropriate for the age and development of the children in your care.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Ensure feedback to children is about their performance and not of a personal nature.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Use positive and age-appropriate language when talking to children and in their presence.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Creating a safe and open working environment.<\/span>\n<ul class=\"ul2\">\n<li class=\"li3\"><span class=\"s1\">Ensure that all physical contact with children is relevant and appropriate to the activity.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Seek permission to touch when doing the above.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not engage in any intimate, over-familiar or sexual relationships with people under the age of 18 years.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Ensure that any filming or photography of children is appropriate. (Obtain consent prior to filing or photographing &amp; explain purpose.)<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Request parental consent before transporting young people in a vehicle. (Ensure vehicle is insured and has a current WOF.)<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Ensure you have parental consent to administer first aid required.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not use alcohol in the presence of children and do not offer alcohol to children under any circumstances.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not engage in communication on a one to one basis or otherwise through social media or email other than relevant coach\/ trainee feedback or administration.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not allow parents, coaches, other children, or spectators to engage in any type of bullying behaviour (this includes cyber bullying).<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not engage in any bullying.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Avoiding situations where you are alone with a child.<\/span>\n<ul class=\"ul2\">\n<li class=\"li3\"><span class=\"s1\">Avoid private or unobserved situations, including being alone with a child in the changing rooms.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Avoid entering changing rooms when children are known to be present. If you must enter, knock and announce yourself and try to have at least one other adult with you.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Avoid driving a child unaccompanied.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not invite or encourage children to your home.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Always have another adult present when staying overnight anywhere with children.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Same sex chaperones should be used wherever possible.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not share a room with a child, other than your own.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>V.\u00a0 \u00a0Code of Conduct<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">BHV has developed the Code of Conduct which sets out its expectations of its employees, coaches, instructors, volunteers and supporters. The Code of Conduct reinforces good practice protocols, complaint and internal discipline procedures for breaches of the code. This is available on the BHV website and is subject to periodic review.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>VI.\u00a0 \u00a0Complaints Procedure<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">In accordance with any person\u2019s responsibility to act on any serious concerns, the following should be brought to the attention of the CPO:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Any instance where this policy is breached, good practice guidelines are not followed or there is an increase in the risk of harm to a child or children<\/span>\n<ul class=\"ul2\">\n<li class=\"li3\"><span class=\"s1\">Initial concerns should be discussed with your CPO (in absence of a CPO the President or Junior Convenor must be notified).<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Consider the allegation and where there is a legitimate concern provide a written notice to the individual(s) involved.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">If the poor practice is continued or repeated poor practice following a written notice then enact the disciplinary procedures set out in the Code of Conduct.<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"li3\"><span class=\"s1\">Any disclosure by a child that abuse or harm is occurring or any suspicions or concerns about a child being subject to abuse.<\/span>\n<ul class=\"ul2\">\n<li class=\"li3\"><span class=\"s1\">The welfare and interests of the child or young person are the first and foremost considerations.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Ensure the child is safe from immediate harm<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Consult immediately with nominated CPO\/ person-in-charge<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Consult immediately with the CPO and\/or person in charge of the event\/activity. <\/span><span class=\"s3\">\uf0d8<\/span><span class=\"s1\"> As soon as possible, record accurately and appropriately the information received<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Records must be factual (not opinion or hearsay) and concise and include<\/span>\n<ul class=\"ul3\">\n<li class=\"li3\"><span class=\"s1\">a. The nature of the allegation<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">b. Who noticed\/ disclosed the abuse and their relationship to the child<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">c. Details of any witnesses (name, address, phone number, email)<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">d. Signs and symptoms noted (including behavioural change)<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">e. Any particular incidents with dates, times and places (if possible)<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">f. Any action taken<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"li3\"><span class=\"s1\">Consult with others as necessary \u2013 do not work alone.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Avoid questioning the child beyond what has already been disclosed.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not question or counsel the alleged offender.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Do not investigate\/ presume expertise unless very experienced and qualified to do so.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Notify Oranga Tamariki, Child, Youth and Family Government Agency and\/or Police.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>VII\u00a0 \u00a0Policy Review<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">This Policy and Procedures will be regularly reviewed:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">In accordance with changes in legislation and guidance on the protection of children or following any changes within BHV.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Following any issues or concerns raised about the protection of children within BHV.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">In all other circumstances, at least every twelve months.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>VIII\u00a0 \u00a0Additional Guidance<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">BHV will:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Have access to a register of every child involved with the group including relevant medical details and have a contact name and number accessible in case of emergencies.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Set an example we would wish others to follow.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Where possible consider activities that involve more than one adult being present or within sight and hearing of others.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Be aware that on occasions our actions may be misinterpreted by others even if they were well-intentioned.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Respect a child\u2019s right to personal privacy.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Provide time and attention for children to talk to us.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Encourage children to respect and be courteous to others.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Intervene to stop any inappropriate verbal or physical behaviour.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Have a pre-arranged policy for the safe collection of children after BHV training and\/or events have finished.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Ensure that any suspicions or allegations of abuse are REFERRED not investigated<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Only refer and seek support from other agencies for those identified under the child protection policy.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Complete Vetting forms.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>Appendix 1:<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>RELEVANT LEGISLATION<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>Health and Safety in Employment Act 1992<\/b><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">This Act deals with the health and safety obligations of an employer to its employees. If a child is an employee of the sports club, the general health and safety obligations of employers under the Act will apply.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">There is also an obligation to ensure the safety of volunteers (some of whom may be children) while they undertake the work activity.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Employers will be held vicariously liable to a third party of acts of its employees. For example, if an employee coach breached a sports club\u2019s duty of care to a child member, the club can be liable.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>Children, Young Persons and their Families Act 1989<\/b><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">The act deals with the responsibility for reporting likely or actual harm in the form of physical or sexual child abuse.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Section 15 of the Act provides that:<\/span><span class=\"s4\"><br \/>\n<\/span><span class=\"s1\">Any person who believes that any child or young person has been, or is likely to be, harmed (whether physically, emotionally or sexually), ill-treated, abused, neglected or deprived may report the matter to Social Worker or a constable.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Section 16 of the Act provides protection for people who report ill treatment or neglect. No civil, criminal, or disciplinary proceedings shall lie against any person in respect of the disclosure or supply, or the manner of the disclosure or supply, by that person pursuant to section 15 of information concerning a child or young person (whether or not that information also concerns any other person), unless the information was disclosed or supplied in bad faith.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>Crimes Act 1961 \u2013 Protection of Children<\/b><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">The key purpose of this part of the Act is to ensure that children are adequately protected from assault, neglect and ill-treatment.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">It places greater responsibility on adults (parent or persons in place of a parent) who have actual care or charge of a child to take reasonable steps to protect that child from injury. While \u2018a person in place of a parent\u2019 is not defined in the Act, it appears possible that sports club personnel could at times be considered to be a \u2018person in place of a parent\u2019. For example, when taking children away to an event or tournament.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">The Act also compels people who live with a child and those who are in frequent contact with children and know, or ought to know, that the child is at risk of death, grievous bodily harm or sexual assault to take reasonable steps to protect the child from that risk.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>Vulnerable Children\u2019s Act 2014<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The Vulnerable Children Act 2014 brought into force a large range of changes to protect vulnerable children and to help them thrive, achieve and belong. This Act includes but is not restricted to:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">More comprehensive safety checking for children\u2019s workers<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Restrictions on people with certain criminal convictions being engaged or employed as core children\u2019s workers (unless they have an exemption). Children\u2019s worker safety checking \u2013 Legislation website Safety checking Safety checking is a careful process of gathering and assessing information. It includes:<\/span>\n<ul class=\"ul2\">\n<li class=\"li3\"><span class=\"s1\">Identity confirmation<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Interviewing<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Referee checking<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Police vetting<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Carrying out risk assessment that assesses the risk the person would pose to the safety of children.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b>Other relevant legislation includes:<\/b><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Privacy Act 1993<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Human Rights Act 1993<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Smoke Free Environments Act 1990<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">New Zealand Bill of Rights Act 1990<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Care of Children Act 2004<\/span><\/li>\n<\/ul>\n<p class=\"p4\"><span class=\"s4\">There are numerous other pieces of legislation relating to the protection of children under 18 years that may impact on sport recreation providers.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>CHILD PROTECTION POLICY Reference: Sport NZ, Safe Sport for Children, Badminton NZ, Bike NZ Policy Statement Badminton Hutt Valley (BHV) is fully committed to safeguarding the welfare of all children in its care.
